Affiliate Program Agreement

Effective date: July 14th, 2026

This Agreement governs participation in the affiliate program of The Unconventional RD, LLC, a California limited liability company (“we,” “us,” “our”). “You” means the person or business enrolling as an affiliate. By applying to or participating in the program, you agree to this Agreement. It’s a real contract, so please read it.

The program lets you earn commissions by referring purchasers to our products (currently including the Search Savvy program) through your unique tracked affiliate link. Our Terms of Service and Privacy Policy also apply to your use of our websites, and purchasers you refer are governed by those documents, not this one.

1. Enrollment and Eligibility

Applications are subject to our approval, and we may decline or later remove any affiliate at our sole discretion. We will decline or remove affiliates whose sites, channels, or promotional venues include: sexually explicit material; violent material; discriminatory content of any kind; illegal activity or the promotion of it; infringement of others’ intellectual property; or anything we reasonably consider damaging to our brand.

Coupon, deal, and promo-aggregator sites are not eligible. We built this program for people with real audiences who genuinely recommend our work, not for sites that intercept purchasers who were already on their way to checkout.

You must be 18 or older and able to receive payments lawfully. If you’re a current member or student, welcome! Your firsthand experience is exactly what makes a good affiliate, and this Agreement applies to you the same way.

2. Links, Tracking, and Attribution

  • We’ll issue you a unique affiliate link. Commissions are only paid on purchases attributed to you by our affiliate software (Easy Affiliate), which is the system of record.
  • Referrals are attributed by a tracking cookie lasting 90 days from the click, on a last-click basis — if a visitor clicks your link and later clicks someone else’s, the most recent click wins. If a visitor purchases after the cookie expires, clears their cookies, or declines tracking cookies via our consent banner, link attribution won’t work; we can’t and don’t guarantee attribution in those cases.
  • Affiliate codes. On request (support@theunconventionalrd.com) we’ll create a custom affiliate code for you. A code entered by your referral at checkout overrides cookie tracking and credits you even if the purchaser last clicked someone else’s link — which makes promoting your code alongside your link the most reliable way to get credit.
  • Attribution is final at purchase. Once a transaction is processed, we do not add, change, or transfer affiliate credit. No retroactively crediting missed attributions and no reassigning credit between affiliates. No exceptions.
  • Maintaining working links in your content is your responsibility. Test them.
  • You’ll get access to an affiliate dashboard showing your clicks, referrals, and earnings.

3. FTC Disclosure Requirements

You are legally required to comply with the FTC’s Endorsement Guides, and compliance is your responsibility. In practice, at minimum:

  • Disclose the relationship clearly and conspicuously everywhere your link appears — every blog post, email, video, podcast episode, and social post. “Clear and conspicuous” means before or immediately alongside the link, in plain language (“I’m an affiliate — I earn a commission if you buy through my link”), not buried in a footer, an “about” page, a linked disclosure page, or a wall of hashtags.
  • In video and audio, the disclosure must be in the content itself (spoken, or clearly on-screen long enough to read), not only in the description.
  • On social platforms, use the disclosure and any platform disclosure tool — the platform tool alone is not sufficient.

We will terminate affiliates who don’t disclose properly. Undisclosed endorsements create legal exposure for you and us.

4. Truthful Promotion

Our marketing doesn’t overpromise, and yours can’t either while representing us:

  • Only make claims we make. You may share results, testimonials, and statistics we’ve published or provided in official affiliate materials. You may share your own genuine experience and results, truthfully and with context.
  • No income or results guarantees. Never state or imply that purchasers will make money, gain traffic, or achieve any specific outcome.
  • No fabricated endorsements. Don’t invent reviews or testimonials, present AI-generated content as your personal experience, or claim to have used products you haven’t.
  • Be clear you’re independent. Don’t state or imply that you own, operate, or officially represent The Unconventional RD, LLC.

5. Commissions

  • Rate: 20% of the purchase price, recurring — you earn 20% of your referral’s initial purchase and 20% of their subsequent renewal payments for as long as they remain a paying customer you referred, unless we agree to a different rate with you in writing for a specific promotion.
  • Qualifying purchases: completed, paid purchases of commissionable products by new customers referred through your link. We’ll identify which products are commissionable (and any exceptions) in the affiliate dashboard or program page.
  • Payment plans: commission is earned on installments as we actually collect them. If a purchaser’s plan defaults, commission stops with their payments.
  • No commission on: your own purchases through your own link (the system may record them; they will not be paid); purchases refunded due to billing error; fraudulent or disputed transactions (including chargebacks — if a commission was already paid on a transaction that is later charged back or reversed, we may deduct it from your future payouts); and purchases that violate this Agreement.
  • No kickbacks: you may not rebate, share, or pay any portion of your commission back to the purchaser as an incentive, discount, or “cash back.” This misrepresents our pricing and is grounds for immediate termination with forfeiture of unpaid commissions.

6. Payouts

  • We pay commissions by the 10th of each month for the prior month’s earned commissions, via PayPal (you’re responsible for having a working PayPal account and for PayPal’s own terms and fees). Example: a commission earned February 1 is paid by March 10.
  • No minimum payout — whatever you earned in a month is paid the following month.
  • Taxes: because commissions are paid through PayPal, tax reporting on those payments is handled by PayPal as the payment processor (via Form 1099-K where its thresholds apply) — we do not collect W-9s or issue 1099-NEC forms for commissions paid via PayPal. 
  • Regardless of whether you receive any tax form, commission income is taxable to you. You are an independent contractor (§10): commissions are paid gross, and your taxes are your responsibility.

7. Prohibited Practices

Any of the following is grounds for immediate termination and forfeiture of unpaid commissions:

  • Spam — unsolicited bulk email, comment spam, DM spam, or any promotion violating CAN-SPAM or equivalent laws. Email promotion is fine only to lists that genuinely opted in to hear from you.
  • Brand-term bidding — bidding on “The Unconventional RD,” “Search Savvy,” “Erica Julson,” or confusingly similar terms/misspellings in any paid search or paid social campaign, or using them in your domain names, subdomains, or social media handles.
  • Cookie stuffing, forced clicks, parasiteware — any software or technique that sets affiliate cookies without a genuine, intentional click, overwrites other affiliates’ tracking, intercepts traffic, or displays our site in an iframe.
  • Impersonation — presenting yourself as us, using our trademarks in ways that imply official status, or replicating our sales pages or checkout.
  • Misleading traffic — pop-unders, forced redirects, incentivized clicks (“click my link to enter the giveaway”), or placing links on the ineligible site types in Section 1.

We monitor for these. Easy Affiliate’s tracking data, plus plain old reading the internet, makes them easier to catch than people think.

8. License to Promotional Materials

While you’re an affiliate in good standing, we grant you a revocable, non-transferable license to use the official promotional materials we provide (swipe copy, graphics, proof points) to promote our products. You may adapt swipe copy to your voice; you may not alter our claims, invent new ones, or use the materials for anything other than promoting us. Our content, courses, and trademarks otherwise remain fully ours — this license doesn’t grant any rights to our course materials, and our Terms of Service restrictions (including no AI-training use of our content) apply. The license ends when your participation ends.

Each of us agrees not to use the other’s name or materials in a way that is disparaging or misleading.

9. Program Changes; Our Products

We may change commission rates, commissionable products, program rules, or this Agreement prospectively at any time, with notice to you by email; rate changes apply to purchases after the change, never retroactively to commissions already earned. We may also change, reprice, or discontinue our own products at any time — we’re not liable to affiliates for product changes, price changes, launch timing, or discontinuations. If you don’t like a change, your remedy is to leave the program (§11); continuing to participate after notice means you accept the change.

10. Independent Contractor

You are an independent contractor. Nothing here creates an employment, agency, partnership, joint-venture, or franchise relationship. You have no authority to make offers, representations, or commitments on our behalf, and you won’t imply otherwise.

11. Term and Termination

This Agreement starts when we approve your enrollment and continues until either party ends it — which either of us may do at any time, with or without cause, by email notice. On termination:

  • Your links deactivate and the §8 license ends immediately; remove our materials from active promotion within 14 days (existing editorial content that merely mentions us can stay — just deactivate/remove the affiliate links).
  • If you leave or we end the program without cause: legitimately earned, unpaid commissions are paid out on the normal schedule.
  • If we terminate for cause (violation of §§3, 4, 5, or 7): unpaid commissions are forfeited. 

12. Disclaimers; Limitation of Liability

The program, dashboard, and tracking are provided “as is,” without warranties of any kind. We don’t guarantee that you will earn anything — affiliate income depends on your audience, effort, and factors outside anyone’s control, and most of the risk-of-effort is yours. To the fullest extent permitted by law, we’re not liable for indirect or consequential damages, and our total liability under this Agreement is capped at the commissions paid or payable to you in the twelve months before the claim arose.

13. Indemnification; Disputes; Governing Law

You’ll indemnify and hold us harmless from third-party claims arising from your promotional activities, your sites and content, your violation of this Agreement, or your violation of any law (including FTC disclosure and anti-spam rules).

Disputes are handled the same way as our Terms of Service: talk to us first (30 days informal resolution), then binding individual arbitration in Alameda County, California (or remotely at your election), with a small-claims carve-out and class-action waiver. California law governs; any non-arbitrable claims go exclusively to the state or federal courts in Alameda County. 

14. General

Severability, no-waiver, and assignment terms mirror our Terms of Service §23: unenforceable provisions are severed or minimized, non-enforcement isn’t waiver, you may not assign this Agreement, and we may assign it in a sale of the business. This Agreement (plus the program page and any written rate agreement between us) is the entire agreement regarding the affiliate program and supersedes all prior affiliate terms, including those previously published on theunconventionalrdbb.com. Notices to you go to the email on your affiliate account; notices to us go to support@theunconventionalrd.com.
